For more than 60 years, the Federal Equal Pay Act (EPA) has been the law of the land. In accordance with the EPA and other federal statutes, covered employers are required to pay equal wages for substantially similar jobs. However, pay inequities persist. Legally, pay equity means that employees should receive equal pay regardless of their race, gender, ethnicity, age, religion, or any other factor unrelated to their job duties. It ensures that employees who perform the same or similar jobs are paid equitably. Because several states and localities have also enacted laws requiring pay equity, employers face the challenge of monitoring and complying with a myriad of regulations.

The EEOC, OFCCP, and plaintiff attorneys are serious, and employers are responding by making necessary changes to company policies and conducting privileged pay equity audits. A pay equity audit has several objectives: identifying internal pay disparities, uncovering pay disparities among comparable positions within the general market area, and finding disparities between company locations.
