On July 19, the Department of Education released new guidance to help schools support students with disabilities and avoid the discriminatory use of discipline.  As the new school year begins, now is an ideal time to consider the new guidance and proactively address any issues that could lead to future legal liability.

Education Secretary Miguel Cardona explained, “The Department has taken steps to address the needs of schools by providing substantial resources to support the challenging work of setting all students up for success and meeting their academic, behavioral, and mental health needs.”  The resources include:
